The greatest competitor was probably Judge Hardiman, who was already a favorite in the estate of Antonin Scalia a year ago, but then lost to Neil Gorsuch. A Woman Among the Top Candidates
Judge Amy Coney Barrett, the only woman among the top candidates, was also a finalist. The question is now how much should Kavanaugh actually be confirmed as a ninth judge, compared to Chief Justice John Roberts. Roberts, on the other hand, should take Kennedy's place in the future and, as a "swing vote", be the most moderate Conservative judge in a court that is likely to slide more toward the right.
Similar to the 50-year-old Gorsuch, Kavanaugh would also be a white man and, at age 53, a young judge likely to serve the Supreme Court for decades. Of the remaining eight judges, three are women and one is colorful.
Initially, however, Kavanaugh will be at the center of a public showdown over the next few weeks. Democrats should do everything possible to challenge his qualifications and postpone the president's appeal to the Supreme Court until after the November 6 congressional elections. However, this attempt will probably be futile: Republicans have a majority in the Senate – and that is the small House of Congress that decides the personal details of the Supreme Court. Majority leader Mitch McConnell had stated in advance that Kavanaugh would be one of the candidates for whom the simplest solution would be to find a majority.
