CRYSTAL FALLS – A man in Argonne, Wisconsin accused of fatally striking an Iron County Road Commission employee with his vehicle on Bates-Amasa Road in January, is set to stand a three-day jury trial in January 2022.
Jerry Mittelstadt, 57, rejected a plea offer at a pre-trial conference Monday in Iron County Magistrates’ Court.
Mittelstadt is charged with a movement offense causing death in a work or school bus area and / or in the alternative reckless driving causing death, both felonies punishable by up to 15 years in prison .
Mittelstadt is charged as a three-time repeat offender and could serve up to 30 years in prison if convicted.
According to the criminal complaint, the incident occurred in Crystal Falls Township on January 13.
Earlier press releases indicated that Mittelstadt – who was not named at the time – failed to stop his van in a marked work area on Bates-Amasa Road and hit Larry Leonarduzzi, 56, while he worked as a flagman near Shady Lane.
Leonarduzzi was trapped between the Mittelstadt vehicle and an Iron County Road Commission vehicle and died on the spot, according to reports. He had worked at the highways commission for more than seven years, said Doug Tomasoski, engineer-director of the commission, in January.
The trial is scheduled to begin on January 25. A further pre-trial is scheduled for December 13.
