A federal appeals court upheld the results of the Pennsylvania presidential election on Friday – leading President Trump’s campaign to deliver one final challenge to the United States Supreme Court.
A three-judge panel of the 3rd U.S. Circuit Court of Appeals in Philadelphia unanimously rejected Trump’s proposal to overturn a lower court ruling, saying “his campaign’s claims had no foundation, ”the Associated Press reported.
“Free and fair elections are the cornerstone of our democracy. The accusations of unfairness are serious. But calling an election unfair doesn’t make it that way, ”Judge Stephanos Bibas wrote.
“Charges require specific allegations and then evidence. We have neither here.
In response, Trump campaign legal counsel Jenna Ellis tweeted a joint statement from her and former mayor Rudolph Giuliani, the campaign’s lead counsel, in which they attacked the decision as money laundering in favor of Joe Biden.
“The activist judiciary in Pennsylvania continues to cover up allegations of massive fraud,” she wrote.
Ellis added: “TO SCOTUS!” – an acronym for the Supreme Court of the United States.
Ellis also said that she and Giuliani were “very grateful for the opportunity to present the evidence and the facts” at a hearing last week held by Republican members of the Pennsylvania State Senate.
Trump phoned the meeting to say the election had been “rigged” and “must be reversed.”
“It was an election that we won easily. We’ve won it a lot, ”Trump said.
Biden beat Trump 51.1% to 47.2% in the popular vote and 306-232 in the votes that will be cast by the electoral college, according to results compiled by Fox News.
On Saturday in Williamsport, Pa., Federal Judge Matthew Brann issued a scathing ruling that rejected Trump’s attempt to overturn the results in Keystone state, saying he was being asked to deprive until ‘to 6.8 million voters.
“One would expect that, in seeking such a surprising outcome, a plaintiff would be formidably armed with compelling legal arguments and factual evidence of rampant corruption,” Brann wrote.
“This does not happen.”
The three judges who upheld Brann’s decision were appointed by Republican presidents, including Bibas, who was appointed by Trump, AP said.
