Nintendo has said that hosting pirated ROMs from other Nintendo products is a violation of copyright and their approach is doubling. This time, the company acted (and won) a lawsuit against two site owners in the United States.
A man and a woman from Arizona were brought to federal court by the company, following a lawsuit initiated early in the year. Jacob and Cristian Mathias have been charged with "massive infringement of copyright and trademark" regarding their LoveROMS.com and LoveRETRO.co sites.
After filing the initial court complaint in July, Mathias and his wife immediately removed the two sites for fear, along with several other ROM site owners who did not want to be next. It turns out that Mathias and Nintendo did not want to go through the lengthy court proceedings, so the settlement discussions started quickly.
TorrentFreak reports that today USD 12,230,000 has been reached for potential damages.
The amount is extremely high for such a low-profile defendant and can be used to warn other ROM site operators to shut down or suffer the consequences. Whether the couple pays the total amount of the settlement or not, we do not know.
The couple has also been forced to hand over control of both sites to Nintendo and if you visit LoveRetro.co or LoveROMS.com, the following message will appear:
"Our website, LoveROMS.com/LoveRetro.co, has previously offered and made unauthorized copies of Nintendo games, in violation of [] copyright and trademarks. LoveROMS.com/LoveRetro.co acknowledges that it has caused harm to Nintendo, its partners and its customers by offering illegal copies of [its] games and agreed to stop all these activities. To access legitimate Nintendo games online, please visit [our site] for information on the [Game Store]. "
