During cross-examination conducted by Tshabalala's lawyer, Annelene van Dan Heever, Makhanya told the court that Nkabinde had stated that his client should be released on bail because the case was of a political nature

Makhanya said that he was shocked by the call of the suspended agent and told his lawyer about it. "My counsel suggested that I call him back and that I make sure he comes to court and that he testifies." [TRADUCTION] "But Mr. Nkabinde informed me that he could not because he was in KwaZulu-Natal."
He called Makhanya on the day in question, Nkabinde, through an affidavit that was read in court by prosecutor Chris Smith, refuted the allegations.
