The district court of
Marseille validated Thursday the sale of a set of restaurants
McDonald's, denounced by their employees, whose fight in the name of employment has received broad political support.
In its judgment, the court dismisses the works council and the CHSCT of all their claims, in particular because they would carry "an infringement manifestly disproportionate to (the) fundamental freedom" to undertake.
What about Saint-Barthélemy?
They demanded the cancellation of a plan to sell six restaurants, five of which have already been sold to another franchisee. The sixth, the McDo of Saint Barthélemy in the northern districts, and its 77 employees, was to become a hallal Asian restaurant but the sale was not completed.
Employees saw in these projects, presented in May, a fraud to remove jobs, and led an intense social movement of several weeks. Employee representatives "proceed by way of unsupported allegations, supporting the thesis of fraud without demonstrating the reality," the judges emphasized. They note the "gap between the expectation of institutions and the role (…) has been devolved by law" to judges to control the sale of companies.
"With regard to Saint-Barthélemy, we will continue to work hoping that the reason will prevail and that the job can be maintained," he added.
