A judge jailed a young woman for two months for causing criminal damage to a 1.50 € tube of Pringle chips in a Tesco supermarket.
Judge Brian O. Shea sentenced Kathleen McDonagh (25) to the Cork court after learning that she had opened the vegetable container at a Tesco outlet where she had been banned when security personnel I had approached it at Christmas 2016.
McDonagh of Inchera, Mahon and Cork pleaded guilty on December 27, 2016, to inflicting criminal damages on the € 1.50 potato snacks package that had been purchased from the Tesco store at Mahon Point Mall. .
Inspector Ronan Kenneally told Judge O. Shea that the Tesco point of sale involved had been banned from the accused on the date in question.
However, she entered the supermarket, took Pringle's tube of chips from a shelf and headed to a self-service area.
Security personnel realized the presence of the accused in the store and went to her to inform her that she was prohibited.
As they approached, she opened the crisp container in front of them.
Inspector Kenneally stated that the defendant had informed the security personnel that she had deliberately opened the package.
"(She said) I opened it then you will have to let me pay for it," he explained.
The court was informed that since the package had been opened and could not be closed, it could not be offered for sale.
Judge O'Shea learned that the defendant had had more than 30 prior convictions.
These included convictions for theft, criminal damage and manipulation of stolen property.
The court learned that the defendant was not allowed to be in the Tesco point of sale that day.
Judge O. Shea was informed that the accused had fully cooperated with Gardaí and had reported his guilty plea as soon as possible.
The young woman had just married and had a history of anxiety.
She is currently attending a beautician and hairdresser course and has found a job during her training.
The defense attorney urged the court to be as lenient as possible towards the young woman.
Judge O. Shea stated that the offense should be considered in the context of what he described as "clever" behavior of the defendant with respect to security personnel, the that she opened Pringle's tube after being asked to leave the supermarket and her conviction history.
The judge said that her behavior towards security personnel the same day had been an aggravating factor.
He noted that a number of conditional sentences pronounced by the district court had apparently failed for the defendant.
Judge O. Shea imposed a four-month sentence of imprisonment but agreed to suspend the last two months in light of her cooperation with Gardaí and her guilty plea.
Recognition was established in the case of an appeal to the Circuit Court.
