8-year-old boy injured on RTÉ concert at € 75,000

A boy who grabbed his finger on a metal chair while he was attending a concert at RTÉ settled his appeal to the High Court for € 75,000.

Thomas Houlihan, who was eight years old when the incident occurred in 2016, had to undergo partial amputation of his left index finger.

Jeremy Maher SC, for the boy, said that he was missing some of the top of that finger but that he had no functional difficulty with that. He is right-handed and has recovered very well, added the lawyer.

Through the intermediary of his mother Natasha Houlihan, Glenshane Crecent, Brookfield, Tallaght, Dublin, the boy sued RTÉ and the board of the St Aidan National School, Jobstown, Tallaght, to following the incident of December 9, 2016.

The boy had been to RTÉ in Donnybrook with his school at the time.

It was claimed that his left index finger was stuck in a metal chair.

An ambulance was called and the boy was taken to a hospital and transferred to another hospital where he was examined by a specialist.

It was claimed that he was suffering a lot, that he could not find a first aid box and that his finger had to be wrapped in a tissue paper.

It was also alleged that the boy and his parents had been traumatized afterwards because, when they first went to the hospital, they appeared to be understaffed. The parents claimed that they had to squeeze the boy's finger to stop the bleeding.

It was alleged that the boy had failed to ensure that the seating of the concert was safe for the user and to take all reasonable measures or precautions for his safety.

The requests were refused.

Judge Kevin Cross approved the settlement.
