A Dublin man was tried for an alleged badual badault on a sleeping woman whom he had met earlier in a nightclub.
Patrick Beauchamp (26) is also accused of having thrown a head at a man who claims to have witnessed the badault and who told Beauchamp: "If it was my sister, I will kill you.
Mr Beauchamp of Pembroke Road, Ballsbridge, Dublin, pleaded not guilty to the Dublin Circuit Criminal Court under a charge of badual badault and two counts of badault causing bodily harm to his home in the early hours of May 10, 2015.
The woman, who could not be identified for legal reasons, testified that she was in Copper Face Jack's nightclub with her friend when she met for the first time an acquaintance and the accused.
The four returned to Mr. Beauchamp's home. She said that she was lying on the couch and that the accused had put her hand on her dress. She told him to stop and pushed him away.
The woman stated that she had fallen asleep and that she had no memory of the alleged badault. She said when she woke up that the two men were already fighting.
His acquaintance testified that he had seen the accused lay on the woman and had her "shaken" with her pants slightly down to reveal her back. He said that she seemed "to be outside of that".
He stated in his testimony that he had told Mr. Beauchamp: "If it was my sister, I would kill you", to which the accused would have replied, "If that is the case," he said. was your sister, I would not give a f ***.
He said that the accused then beat him on the head. He added that they had started fighting and continued to do so until Mr. Beauchamp's older brother came down and told them to stop.
He then said that he had gone with the woman and her friend, but that Mr. Beauchamp had followed him to the street. They exchanged words and then the accused punched him in the face with his fist.
Garda Tara Power testified that she was doing a routine patrol that morning and saw the accused hitting the man in the face.
Mr. Beauchamp told the jury that he had not yet mastered the woman. He said that the other man had become aggressive towards him and that he had acted in self-defense.
He said that he had hit him with a clenched fist, but that he had not hit him in the head. He said that he had followed the group out of the house to get the woman's last name and that this man had hit her first again.
Mr. Beauchamp stated that the woman was lying around him putting his hand in her skirt and that, apart from a kiss in the kitchen, he had not touched her at all. He added that she had not fallen asleep on the couch and that she was standing next to him when the fighting started.
The trial will continue tomorrow afternoon when Judge Patricia Ryan will instruct the jury of six women and six men.
