A Dublin man who touched the shoulder of another bus pbadenger with his penis claimed he was urinating when the vehicle jumped forward and pushed him towards the woman.

Thomas McMahon (35), of Aideen Avenue, Terenure, was to be sentenced in Dublin Criminal Court after pleading guilty to having been exposed on June 28, 2017 on a bus from Dublin to Crumlin. The sentence carries a maximum penalty of two years.

Garda Conor O'Neill agreed with David Staunton, BL, in defense, that the victim told Gardaí that the bus had leapt forward when she noticed McMahon's penis on his shoulder.

He also accepted the fact that McMahon had stated to have problems urinating because of his addiction to alcohol and drugs and that even though he did not remember him, he was not sure he had any problems with alcohol. incident, he thought that it was very likely that he went to the back of the bus to urinate.

It was further admitted that McMahon was disgusted by his behavior and extremely remorseful.

Mr. Staunton told Justice Melanie Greally that McMahon "was not vicious because of his addiction".

"He had gone to the back of the bus with the intention of urinating. There was no badual element to this. He was not trying to badually satisfy himself to make contact with her, "said the lawyer.

Greally J. noted that McMahon had mental health issues and adjourned the case on March 13 for his sentence. She ordered a psychiatric report for that date.

Gda O'Neill told Siobhán Ní Chúlacháin BL, who was suing, that the woman was driving to the village by bus when she noticed that one man was sitting alone in the other aisle.

The woman prepared a victim impact report in which she said it was "the scariest thing that happened to me on a bus". She took two days off but otherwise, the incident did not have a lasting impact on her.

Gda O'Neill confirmed that McMahon had been identified as a CCTV suspect on the bus. He was arrested and cooperated with the investigation, although he stated that he did not remember the incident.

McMahon has already delivered 10 convictions for district court offenses, such as public order and badault.
