A judge ordered the arrest of a bus driver accused of dangerous driving and impaired driving on the M7 at Co Kildare last month.
Michael Connolly of Rossport, Ballina, Mayo County, reportedly exceeded the legal limit by more than nine times on October 2, 2018.
The Naas District Court has learned today that there will be no further charges and that the Director of Public Prosecutions has ordered that the case be tried by a court of law. district.
Judge Desmond Zaidan accepted the jurisdiction today but issued a warrant for arrest when Mr. Connolly did not come to court.
The judge also stated that the warrant should be executed "with discretion", which usually means that if the accused appeared in court at another date, the warrant could be set aside.
The court has already heard that the state alleges that it has been reported that a bus derailed on the M7 on 2 October.
It is alleged that Gardaí went to the scene with flashing lights and immobilized the bus on the shoulder.
Speaking to the driver, they told themselves that he was in a state of drunkenness.
The driver has been arrested.
He would have had 84 mg of alcohol in his system. The limit for a bus driver is 9 mg of alcohol per 100 ml of breath.
