Parents can use the sperm of their deceased son to make grandchildren, judge rules: The norm

A New York judge ruled that the parents of a 21-year-old cadet from the US Military Academy could use the frozen semen of their deceased son to produce a child.

Peter Zhu, West Point cadet, single, died of a ski accident on February 23.
He had been found insensitive on a ski slope in the compound of the North York State Military Academy.
Zhu was then taken to the hospital, where he was pronounced brain dead a few days later.
In March, his parents asked the court to allow the hospital to recover and freeze their son's sperm at the same time that his organs would be removed.
The petition was accepted and the semen was kept in a sperm bank after recovery.
His organs were also collected to help those waiting for a rescue transplant before his burial at West Point Cemetery.
According to CNN, the decision of Supreme Court Justice John Colangelo gave Zhu's parents an opportunity to try to conceive with a surrogate mother using their son's sperm.
"At this point, the court will not impose any restrictions on the use that Peter's parents could make of their son's sperm, including its potential use for procreation," wrote Colangelo.
"They will own and control the disposition and potential use of their son Peter's genetic material."
Zhu's case is not the first such incident, according to AP.
In 2007, an Iowa court authorized the recovery of a man's sperm by his parents to give it to his fiance for future use in procreation.
In 2009, a Texas woman obtained permission from a judge to extract sperm from her 21-year-old son after her death, with the intention of hiring a surrogate mother to give her grandchild.
In 2018, the American Society for Reproductive Medicine issued ethical guidelines for fertility centers on the posthumous collection of reproductive tissue.
The organization said that it was justifiable if it was authorized in writing by the deceased. Otherwise, programs should only consider requests from the surviving spouse or partner.
