President Yoweri Museveni has been given the green light to challenge the Ugandan presidency in 2021, even after the age of 75.
The Supreme Court of Uganda confirmed on Thursday a 2018 Constitutional Court ruling that Museveni, elected for the fourth time in 2016, could stand as a candidate.
Judge Eldad Mwangusya, led by Chief Justice Bart Katureeba, read the court's final decision.
"By a majority decision of 4 to 3 on the process of adoption of the law, fails. The confrontation with violence, both inside and outside parliament, is failing, "he said.
"On the test of materiality, fails. By unanimous decision of the court, during the vacancy of the president after 75 years, fails. The decision of the constitutional court is confirmed.
The Supreme Court met to consider eight key issues. Among the other relevant issues is whether the majority of Constitutional Court judges erred in concluding that the process of conceptualizing, debating and enacting the Constitution Amendment Act which removed the limitation of Age did not violate the constitution or parliamentary procedures.
They also considered whether the Constitutional Court judges had erred in holding that the removal of the age limit was not in accordance with the Constitution, and if they had concluded that violence and fighting inside and outside Parliament was contrary to the constitution.
The decision of four out of seven judges contradicted three judges who had found the process leading to the amendment of the null age limit, avoided and contrary to the Ugandan constitution.
The judges who ruled in favor of the appellants also argued that the certificate of conformity accompanying the bill was defective because it contained provisions not mentioned. They also decided that the President had the duty to bring them to the attention of the speaker before accepting it.
