Three people convicted of terrorist attack at Garissa University must be the subject of a conviction

A Nairobi court on Wednesday sentenced three people and acquitted one of them for the terrorist attack on Garissa University, which killed 156 people.

The court sentenced the three people – Mohammed Abdi Abdikar, Hbadan Hbadan Edin and Rashid Mberesero – for being accused of belonging to Al Shabab, terrorist acts and conspiracy to commit terrorist acts.

"The Prosecution has proved beyond reasonable doubt," trial judge Francis Andayi said, adding that the three men were in contact with the attackers and knew the plot.

"The court found that they knew the plot and were part of the attackers during their arrest while they were coming from Garissa two days after the attack," said magistrate Andayi.

When sentencing the three people, the magistrate noted that the attack was carried out with the aim of forcing the government to return the Kenya Defense Forces (KDF) from Somalia.

According to the court, the 5th accused – Rashid Mberesero – led the attackers to the institution because he never explained the reasons for his absence on the scene.

"He stayed in the hostel when everyone left and could not explain satisfactorily why he was there," the court noted.

Meanwhile, the third defendant – Sahal Diriy Hussein – was acquitted of all charges against him.

"The third defendant is a non-guilty person, the prosecution has not proved his case," said the magistrate.

The sentenced persons' sentence was set for July 3, 2019. Attorney Duncan Ondimu stated that he would seek the maximum sentence.

More than 22 witnesses appeared in this case among them students and experts.
