A federal judge in New York on Tuesday rejected an application to allow unvaccinated children to return to school.
US District Court Judge Vincent Briccetti stated that 44 students were not allowed to resume their classes at the Green Meadow Waldorf School in Rockland County, NY, citing an " unprecedented measles outbreak, "according to the Rockland / Westchester Journal News.
Briccetti sentenced a lawyer representing parents of students, who filed a lawsuit against the Rockland Department of Health and its commissioner for not allowing unvaccinated children to go to school.
The prosecution argued that the Ministry of Health's decision to forbid students from leaving the campus violated the right of families not to vaccinate their children for religious reasons.
"The plaintiffs have not shown that the public interest weighs in favor of the injunction," Briccetti told the court on Tuesday, according to the newspaper.
Parents of unvaccinated children say that none of them has contracted measles.
The county has been dealing with a measles outbreak since last fall.
The briefing noted that 145 cases of measles had been reported in the region since October, with three other suspected cases currently under investigation.
In December, the Rockland Health Department ordered certain schools with specific postal codes whose vaccination rate was less than 95% to prohibit unvaccinated children from going to school. .
