The Delta Resort in the Canton Ticino will become a luxury residential area: There Park Hotel had 52 condominiums built and mostly Swiss Germans eager to realize their dream of luxury living. However, the relevant municipality retrospectively withdrew the approval of the residential area – and now threatens the new owners of eviction.

As reported by the Swiss newspaper "Blick", the Park Hotel let 40 million francs worth of luxury apartments, or 35 million euros, cost. The finished properties are now sold for an average of about 2 million euros. But interested parties could stay away now out of fear. Because the new owners, who have already hit, are not welcome.

The problem according to "Blick": The Park Hotel is located in the municipality of Ascona, but the luxury apartments in the nearby town of Locarno. In 2009, the construction of real estate had been approved there, but five years later, the city council after criticizing the decision in retrospect massive concessions. The biggest change: The Delta Resort is no longer a residential area.

Buyers of apartments have been informed accordingly that they are allowed a maximum of eight weeks a year in their new apartments may – because that it is a hotel. Among those affected, there is an elderly German-Swiss couple who have lived in Ticino for 30 years. They rented one of the hotel's apartments for five years as their primary residence in the Delta Resort – and are now facing a problem.

"Locarno acts in pure arbitrariness," said lawyer Fulvio Pelli. "This eight-week decision has never been communicated to homeowners." She first appeared in May in a ruling made to the couple who had rented one of the apartments. Pelli is preparing a claim for damages of more than 20 million francs for the Park Hotel. Terms of use have been changed to "illegal".

"Who buys an apartment which he can not dispose of?" Complains the director of the Park Hotel, Alessandro Ambrosoli, to the newspaper. The hotel planned to keep 10 apartments and rent to the guests. The remaining 42 properties should, however, be sold to new owners. "We are threatening to sit on the remaining apartments."

As reported by "Blick", the former president of the Ticino Administrative Court, Lorenzo Anastasi, had already warned the community. As an expert, he urgently advised Locarno to find a compromise with the hotel owners – otherwise, he would risk to claim damages. The community is turning to the upcoming legal dispute, but apparently calmly.
