SHAH ALAM: The High Court Shah Alam rejected an offer to postpone the takeover of the land housing Sri Maha Mariamman Temple in Seafield, Subang Jaya, which was the scene of violent clashes as a result of the 39th attack of an unknown group by the crowd on Monday.
The decision of Judge M Gunalan means that the process of relocation of the temple, as agreed between the landowner One City Development, the Selangor government and two groups representing the temple, would go forward.
The request to postpone the relocation was filed by three people – S Thangarajoo, M Mohanakrishnan and S Nagarajah.
Nagarajah, who initiated the lawsuit last month, had previously failed to oust the temple director, K Chellapa, in a separate lawsuit. Chellapa said that he was complying with a consent judgment to move the temple.
The trio's lawyer, S Mogan, said that despite the decision made today, his clients would take legal action against the developer, the Selangor State Government and the Temple Committee, which are part of consent judgment rendered in 2014.
"The court said that the three people who requested the suspension order did not explain to the court why the deportation was not taking place," Mogan told reporters.
At the same time, VK Regu, Task Force Leader of the Save Maha Mariamman Temple, who was appearing in court for another temple-related case, said that Judge Gunalan was free to listen. the second lawsuit brought by him and other persons.
"I was informed that the judge did not want to prejudice my case when he was seeking an eviction injunction because he was hearing another case involving the devotees," Regu said.
The temple was to be relocated on November 22, but in a half-turn, Nagaraju insisted that the temple remain at its current location instead of being moved about 3 km away.
By virtue of the consent judgment rendered in 2014, One City agreed to donate RM 1.5 million for the construction of a new temple on one of the two plots given by the company.
After the temple had surrendered rights to one of the two parcels of land, One City granted him another compensation of one million RM.
