This is apparent from the judgment of the Namdal District Court.
It was May 15 of last year that the wife would help her family clean up a bit in the garden in front of their apartment in the residential area of Fossbrenna in Namsos.
"My sister and I agreed to pick up grass and twigs and burn them in the garden," the woman told Namdal District Court in early November.
The woman lost control of the fire, which quickly caught fire in the wall of a townhouse. The fire department was primarily concerned with saving other houses located near the townhouse. A whole series of apartments was destroyed, but fortunately no one was injured in the fire.
More than 11 million claims for compensation
Under Article 352 of the Penal Code, the fire destroyed five apartments and the woman was accused of gross negligence when she lit the fire in the garden.
During the trial, the prosecutor claimed an 18-day prison sentence for the woman and that she had to pay a claim for compensation to Sparebank 1 Forsikring, Frende Forsikring, DnB Forsikring and Storebrand Forsikring ranging up to 11 million NOK.
– I partially recognize the penalties, but this has never been designed to start a fire. I also did not have the opportunity to pay compensation, "said the woman in the district court.
Not grossly careless
The minority, the president of the court, felt that the woman had acted with flagrant negligence and that she should be sentenced.
The majority, however, found that it was not proven that the woman had done something very blameless. They think she did not act carelessly by setting fire to the quarry.
Thus, the woman was acquitted both of the compensation claim paid to the insurance companies and to the private person. The only thing she has to pay after the verdict is a replacement amount (deductible) of 6,000 crowns per person and 4,000 crowns.
