Gilmar Mendes orders to file an investigation that determined the alleged involvement of Aecio in the Furnas case | Policy

The Attorney General's office requested that the case be remitted to the lower court, but Minister Gilmar Mendes decided to dismiss the case.

The investigation of the Toucan parliamentarian was an offshoot of the Lava Jato operation. Aécio was suspected of having received bribes, through the former director of Furnas Dimas Toledo because of the money diverted into contracts with companies under -traitées.

In his award-winning report, Senator Cbadado Delcidio do Amaral (without a party of the MS) told the Attorney General's office that Aecio was beneficiary of a "major corruption program" within the public company Furnas.

This scheme, according to Delcício, was operationalized by Dimas Toledo, former director of engineering of the company who would have "a very strong bond" with Aécio.

In the ruling, Minister Gilmar Mendes reported that the federal police requested the closure of the case "given the absence of evidence of the existence of the crimes". According to him, the prosecution stayed for two months with the case for badysis, and returned "without conclusive demonstration". Gilmar Mendes said that he was giving a longer period and after that, the Attorney General's office requested the referral of the case to the Federal Court's first instance in Rio de Janeiro.

"The ongoing investigation, during an unreasonable period, without amparo in a clear suspicion, offends the right to reasonable length of proceedings and the dignity of the human person," Mendes said.

The minister also said that the decision to file the case after the PGR's request to be sent to the lower court has already been taken in other cases by Lava Jato by the ministers Alexander de Moraes and Luís Roberto Barroso.
