Justice Sérgia Maria Mendonça Miranda became accused by the sale of judicial sentences on Wednesday (5). The crime was the subject of an investigation as part of the operation "Expresso 150", initiated by the federal police. The denunciation was received after a unanimous decision of ten ministers of the Superior Court of Justice (STJ).
The PF investigates the participation of judges and lawyers in a habeas corpus sale scheme aimed at releasing criminals under the sheriff's leadership. According to information provided by the prosecution, lawyers paid up to R $ 150,000 for the court's decision that benefited the criminals.
Judge Herman Benjamin of STJ dismissed the magistrate in September 2016. As early as November 2017, the federal public prosecutor's office of the Federal District accused him of pbadive bribery. Sérgia Maria and five other people were suspected of having negotiated the sale of at least six habeas corpus to the Ceará Court of Justice (CETJ). A single judicial decision by the arbitrator would have cost the parties concerned R $ 217,000.
According to the plaintiff's lawyer, Anamaria Prates, the deliberation should be published only in February or March 2019. "After that, she will be asked to present her defense within five days" , he says.
The defense of the magistrate considers that the trial will not lead to the conviction because "the evidence is insufficient to indicate participation in the crime".
Sérgia Maria is having her money and property removed by the STJ in April of this year. In addition to the amount available on the current account, an additional amount of R $ 63,369.18 related to the salaries of the judge dismissed from the ECJ was blocked. At the time, the plaintiff stated that the amounts were the result of lawful activities for participating in work and a loan contracted from the public bank.
The first phase of "Operation Expresso 150" was launched in 2015. The investigation took place after the evidence of the existence of the ploy had been revealed during the course of Another operation of the Federal Police, Operation School.
