The defense appealed to the Rio Regional Court of the Second Region (TRF-2) and the Superior Court of Justice (STJ) in Brasilia, but applications for release were rejected.
Gilmar understood that the pre-trial detention was not based on "concrete evidence". Thus, he extended to Wilson Carlos the decision that had already benefited Hudson Braga, former Secretary of Public Works of the Government of Cabral.
According to Gilmar's badessment, the preventive prisons of Wilson Carlos and Hudson Braga do not meet the requirements of Article 312 of the Code of Criminal Procedure (CCP), under which the measure "may be decreed as a guarantee of public order, economic order, for the convenience of criminal investigation or to ensure the enforcement of criminal law, when there is evidence of the law; existence of the crime and a sufficient indication of its authorship. "
Sérgio Cabral, Hudson Braga and Wilson Carlos were arrested as part of Operation Calicute. According to surveys, the group of the former governor has diverted contracts worth about R $ 224 million with several contractors.
