Tião Biazzo's defense stated that he did not yet know the content of the decision, but that he would appeal when notified. The lawyer and nephew of the former mayor José Ricardo Biazzo Simon said that the action of the mayor was not lacking.
"We are certain that a conviction can only be pronounced in the event that the defense arguments have not even been examined because the mayor has never been inactive."

Tião Biazzo held his sixth term in Aguaí between 2013 and 2016, a period to which the conviction refers. He was elected in 2012 at the age of 89 years with 44.47% of the votes cast and became the oldest mayor of Brazil at the time.
He was also Mayor of Aguaí from 1960 to 1963, from 1969 to 1972, from 1983 to 1988, from 1993 to 1996 and from 2005 to 2008.
