The federal police of São Paulo arrested the mayor of Mauá, Átila Jacomussi (PSB), and the former city secretary of the city, João Eduardo Gaspar, during the operation Trato Feito. The investigation revealed that nine companies, from different branches, paid a bribe to the mayor each month.
Federal Judge Raquel Silveira of the Federal Regional Court of the 3rd Region also authorized the execution of the search and seizure warrants in the offices of 22 of the 23 councilors. The PF also has search warrants in the city of Mauá, at the headquarters of Sama (basic sanitation of the municipality of Mauá) and at Ione Scapinelli, coordinator of the government secretariat of Mauá.
The operation of this farm is a development of the Prato Feito-PF Working Group and the Comptroller General of the Union (CGU), which began in May this year and examines the embezzlement of federal funds to purchase school meals in three states (São Paulo, Paraná and Bahia) and in the Federal District.
At the time, the investigators seized from João Eduardo Gaspar several documents, spreadsheets, lists and manuscripts that indicated, according to the PF, the existence of a sophisticated scheme of corruption involving Mayor Átila Jacomussi, former secretary of the government and 22 of the 23 councilors.
According to the PF, the nine companies that have entered into contracts for the supply of service or supply of equipment for the prefecture of Mauá, monthly training paid to Attila Jacomussi. The former secretary of the government redistributes the values to the other members of the group. Fees ranged from 10% to 20% of the contract value. Corporate offices are also the subject of research.
In May, during the Prato Feito operation, Attila Jacomussi and João Eduardo Gaspar had already been arrested in the act of bribery. At Jacomussi's home, the PF seized $ 85,000 in cash. With Gaspar, the researchers found R $ 588,000 and almost € 3,000. The pre-trial detention order against Jacomussi and Gapar was revoked on June 15, 2018 by a habeas corpus of Minister Gilmar Mendes of the Federal Supreme Court (STF).
TRF3 therefore imposed on Jacomussi five provisional measures, including the suspension, on a preliminary basis, of the exercise of the post of mayor. But the order was also revoked by decision of Minister Gilmar Mendes, and Jacomussi was able to resume his duties on September 11 of this year.
The PF reports that 22 applications against 1 have been rejected by the municipality of Mauá on two requests for impeachment of the mayor, which corresponds exactly to the number of counselors who, according to the worksheets entered, receive a bribe. de-vin of the alleged stratagem chaired by Jacomussi.
Delegate Melissa Maximino Pastor, Delector (Delecor), Office of the Prefect for the Suppression of Corruption and Financial Crimes, asked the court to dismiss the 22 councilors suspected of involvement in the scheme, but his request was rejected. The judge ruled that the measure could "lead to a situation of total ungovernability of the municipality".
According to Jacomussi's lawyer, Daniel Bialski, "they use the same arguments of the previous prison and for this reason, I will lodge a complaint with the STF because they were removed by the decision that long restored freedom. "
