RIO – A decree issued Thursday by the Rio de Janeiro City Council suspended, for 19 months, the collection of tolls for the Fundão yellow line. The alleged reason would be an improper levy in the amount of R $ 223.9 million, revealed during an audit by a committee of the municipal departments of transport, infrastructure and housing and the Comptroller General of the municipality. The toll cleaning took place on Thursday afternoon. Lamsa, a road dealership, said he would appeal. According to the city council, the road receives 91,000 cars a day, 41,000 of which are in the direction of Fundão.
In justifying his decision, Mayor Marcelo Crivella said that the partial conclusion of a working group had revealed an economic and financial imbalance to the detriment of the municipality, in the concession of toll collection. According to Crivella, the fairest way to return these amounts is to benefit the user by reducing the rate by suspending collection in one of the following ways:
– The yellow line contains accounts to be revised. The town hall has spent six months reviewing, giving Lamsa an opportunity to seek clarification and answer questions. The toll in the direction of Barra-Fundão has been open for 19 months. It is possible that this period increases or decreases depending on the number of cars that will circulate there. But it will be about $ 200 million that will be reimbursed to users with the toll-free number – says Crivella.
In the opinion of the City Council, Lamsa's irregular charges refer to a number of infrastructural works that resulted in an increase in the duration of the contract and poorly agreed rates.
The decree further stipulates that the Municipal Department of Transportation and the City Comptroller General continue and deepen the audit in order to detail the expenses incurred by Lamsa that have not been clarified. Depending on the result, the amounts to be repaid may increase.
Lamsa goes to court
Lamsa announced that it would take legal action and execute the concession contract for 21 years. According to the concessionaire, the town hall's position violates the terms of the contract and "represents a threat to the legal security of concession contracts in general".

The dealer reiterates that he has strictly complied with his concession contract for 21 years. Like the entire Invepar group, Lamsa is committed to ethics, transparency and integrity in all its relationships, whether with the authority responsible, its users or suppliers.
The positioning of the City Hall of Rio de Janeiro violates the terms of the concession contract. The position of the current mayor threatens the legal certainty of concession contracts in general. It lacks respect for what is established by contract with a company that invests and has a history of significant contributions to the mobility and development of the city.
The investments made meant greater fluidity, the solution of the old problems around the Yellow Line and the consequent improvement in the quality of urban mobility in Rio de Janeiro:
– Reclaiming the roadway and signaling the red line on a 6 km stretch near the yellow line;
– Extension of a strip in each direction of avenue Bento Ribeiro Dantas and cbadization of the marginal river up to via;
– Extension of a strip in each direction of the Manguinhos Viaduct;
– Recovery of the side lane of Brazil Avenue, reallocation and expansion of the bus bay of Fiocruz;
– Installation of a new viaduct on the yellow line connecting the two sides of the Rua da Abolição;
– Recovery of the Ayrton Senna Avenue side lane, reallocation and extension of the Gardênia bus bay;
– Establishment of three lanes on Ayrton Senna Avenue, recovery of the existing runway lining in the direction of Barra and implantation of a new drainage network;
– Implementation of protection panels along the yellow and red lines and urbanization of linear parks in several communities.
