The former mayor of Nova Iguaçu and the current Senator Lindbergh Farias (PT) were found guilty of administrative irregularities due to the management of the Municipality of Baixada Fluminense in 2007. Lindbergh denies these irregularities.
The public prosecutor's office was denounced by the Federal Public Prosecutor's Office (MPF) for failing to take into account the agreement to adapt schools to students with special needs. The agreement was concluded for an amount of R $ 174,000 between the City and the National Fund for Educational Development (FNDE).
He was sentenced to pay a fine equivalent to 12 times the salary he received as mayor. Lindbergh says he's going to appeal.
"Senator Lindbergh Farias understands that the decision of the Federal Court of Nova Iguaçu is erroneous and will be amended by the Federal Regional Court.In addition to a clear restriction in his rights of defense, was not of his responsibility as mayor, "says the memo.
According to the MPF, the former mayor should have been accountable and present the necessary documents to the badessment of the FNDE at the end of the agreement.
"The absence of responsibility of the former mayor can not be interpreted as a mere non-compliance with legal formalities, which can be corrected by the subsequent performance of the obligation by the subsequent administration, their behavior making it impossible to regularize the reports, "said the prosecutors.
