BRASÍLIA – The last day of operation of the
Federal Supreme Court (STF)
it really seemed like the end of the world, with a shower of controversial decisions. The most impressive is the possible release of former President Luiz Inacio
Lula
da Silva, dismissed nearly six hours later. Amidst the confusion, the court 's fire alarm went off twice, for no apparent reason. It was the soundtrack of chaos.
There was no fire (literally) in the STF. Nevertheless, starting at 3 pm on Wednesday, when the hearing officially began, the president, Minister Dias Toffoli, was given the title of official firefighter of the Republic. It first erased the fire caused by the decision of Marco Aurélio Mello on the prisoners of the second degree. You will now have hundreds of decisions to make.
It is that during the suspension of the hearing, the court is working on duty. Toffoli will only make urgent decisions; many of them, in resources of previous decisions written by his colleagues. Only Wednesday, 212 supposedly urgent requests arrived at the table of Toffoli. These were grievances, appeals, habeas corpus petitions and suspension of injunctions. Thursday until 5:15 pm, three other resources were sent to Toffoli; among them, a request for release of religious leader João de Deus, arrested since Sunday, suspected of having committed badual badault during spiritual treatment.
In the last minutes of the official FST operation in 2018, Marco Aurélio decided that the vote in the Senate for the election of the president be opened. The election is scheduled for February 2019 and, according to the rules of procedure of the House, is by secret ballot. In the Senate, it was announced the referral of an appeal to the Supreme Court to try to overturn the decision made during the change.
Also on Wednesday, Ricardo Lewandowski suspended the validity of an interim measure postponing to 2020 the readjustment of officials. With this, the readjustment will have to be paid from January. The impact of the decision on the public coffers is R $ 4.7 billion, an account that will be paid by the government of Jair Bolsonaro. The Union's appeal is also expected in court, but experts from the Prosecutor General's Office (AGU) report that it is difficult to try to overturn this decision.
Another decision by Marco Aurélio can be questioned. It suspended the effects of the decree which defines the rules for the transfer of rights to explore and develop oil and gas production by Petrobras. In practice, the decision leaves the state badet sales program without clear rules. The state has not yet expressed its opinion on the issue.
