"Duck Blade" – in literal language – is an American expression designed for politicians still in office, but whose successors have been chosen. The term suggests that the politician in this state has more strength and spends the remaining days in the position that just fills the table, waiting for the time to deliver the lead to the new manager.

Michel Temer is technically a "lame duck", already a few days away from pbading the presidential torch to Jair Bolsonaro. But the government of the emedebista has taken, in recent days, decisions that contradict the maximum of the manager in the countdown. Actions in various fields such as infrastructure, security and sports reveal an unexpected strength – at this stage – of the Temer government and have caused concern in the team of the future President of the Republic

High Voltage

The electric power sector is one of the most influenced by these latest acts of the Temer government. On Friday (28), the emedebista issued a decree that determines the gradual end, within five years, of subsidies in the count of light. These are increases in the price of electricity, paid for by all Brazilians, that should be used to finance specific projects such as rural lighting, but they eventually became uncontrollable and cost even today. some sanitation projects.

The reduction in subsidies was one of the main flags of the Minister of Mines and Energy, Moreira Franco. He also promoted on Friday another measure of impact: the auction of Companhia Energética de Alagoas (CEAL), the last subsidiary of Eletrobras put on sale this year. The event was won by Equatorial Energia, which also operates in Maranhão and Pará.

Still in the field of electricity, the 28th has also been issued an ordinance that extends the free market of energy consumption, in which large consumers can opt for any service provider in the region. For the new text, those who consume more than 2,500 kW can already be on the open market. The ministry added that it is expected that the barrier will be reduced to 2,000 kW by 2020.

Structure

The 28th also saw the publication by Temer of a Provisional measure creating new rules for the procurement of sanitation companies. The rule determines that prefectures must bid in all areas of recruitment. According to the previous rule, auctions could be canceled if a public company entered the negotiations.

This measure was celebrated by companies in the sector, which are witnessing a market expansion, in line with the guidelines of the Bolsonaro government, which promises to be the champion of free initiative. The answers to this idea are that public enterprises could offer cheaper services to poor municipalities, which would be unattractive for private companies.

Still in the area of infrastructure, another recent action by Temer was the adoption of Law 13.786 / 2018, called the Law of Distraction. The standard states that consumers who waive the purchase of a property traded in the factory will have to pay a fine of 50% of the amount already paid.

The proposal was found to be abusive by consumer protection agencies, who pointed out that the usual penalties were 10% to 20% fine.

Security

Also in the erasing of his government's lights, Michel Temer instituted the National Plan for Public Security and Defense. Social Network (PNSP). The decree with the norm was signed Thursday (27).

The plan will be valid for 10 years and will cover several areas of the fight against violence, such as homicide reduction targets, domestic violence and the suppression of organized crime. The proposal also aims to broaden the actions of municipalities to promote security, social protection and improve the conditions of the penitentiary system.

This is the fourth national security plan presented since 2000. The precedents were announced by the former presidents Fernando Henrique Cardoso in 2000 by Luiz Inácio Lula da Silva in 2007 and by Dilma Rousseff in 2012. The Violence was one of the topics discussed. Jair Bolsonaro, then a presidential candidate, participated in the presidential race because of the more than 60,000 homicides recorded in Brazil in 2017.

Another decision in the field of security of the last days – more precisely Friday (28) – was: the creation of the National Authority for the Protection of Personal Data (ANPD).

Aim against

One of the most controversial measures taken by Temer's leadership in recent days has been the reduction of the Bolsa Athlete program, released on Friday (28). The decision of the emedebista reduced the project budget from 150 million rand to 53.6 million rand and terminated the scholarships for young athletes and basic categories.

The Bolsa athlete was launched in 2004 and is one of the main sources of livelihood for beginning athletes or modalities of practice with less sponsorship. For payment, athletes are divided into levels, based on criteria such as age and results achieved throughout the career.

In 2016, the project envisaged 7,223 athletes.

Action and Reaction

Still Thursday (27), even before the last measurements of Michel Temer's latest package, Jair Bolsonaro's team published a document entitled "Government Agenda" which, besides the 39 setting priorities for the beginning of the new administration, indicated that a "fine" would be promoted for the latest acts of emedebista. The exam should be completed during the first 10 days of government and will focus on the last 60 days of work of Temer and his team.

The text provides for the possible revision of normative legal acts or offenses and efforts to identify overlaps. and gaps in the structure of government. The future Minister of the Civil House, Onyx Lorenzoni, said the document shows that the transitional team "is not working with improvisation" and stressed that the Bolsonaro administration would proceed with periodic reviews of government performance. It is also feared that Temer will leave the new team with "tax bombs", such as budget amendments approved by MPs and Senators.

Despite recent statements, the climate between the current government and the future has been relatively calm during the post-election period. At a meeting in early November, Bolsonaro said that "the Temer government would do a lot" and that President Emedebista invited the future president to accompany him to the G-20 meeting that was held. held in Argentina. Bolsonaro declined for health reasons

Other Examples

The last two presidents who left office on December 31, FHC (in 2002) and Lula (in 2010), also advocated actions that affected the last days of management.

The Toucan and the PT both published seven interim measures between December 27 and 31.

One of the deputies published by FHC introduced protective measures in the computer industry, exempting from the tax on industrialized products (IPI)) machines costing less than R 11,000 $. The Toucan also extended the 27.5% rate of personal income tax until the end of 2003, resulting in a $ 950 million increase in taxes collected.

Lula, the last day of 2010, made a decision that has effects so far: the refusal to extradite Cesare Battisti, an Italian political activist accused of homicide in his country. With the measure of the former president, the Italian managed to stay in Brazil and lived there until the 13th, when the Minister of the Federal Supreme Court (STF), Luiz Fux, ordered his arrest. Battisti has been a fugitive ever since.
