), Minister Dias Toffoli, denied a
request for injunction
against the appointment of the son of Vice President Hamilton
Mourão
as special advisor to the presidency of Banco do Brasil. The promotion, which took place after the inauguration of the Bolsonaro administration, reduced the salary of Antonio Hamilton Rossell Mourão, triple employee, from 12,000 to 36,000 rand a month.
The action in the Supreme Court, which called into question the indication, had been brought by a common citizen, Felipe Torello Teixeira Nogueira. He stated in the trial that the case was directed at the court's own summons, which prohibited nepotism in the government. But Toffoli understood that the request did not meet the requirements established by law, such as "the exhaustion of administrative channels", and therefore could not continue to be dealt with in court.
"In other words, in the complaint against an administrative act for alleged violation of the declaration of binding force, the author must demonstrate that he has a subjective right whose enjoyment presupposes a act of authority, as well as evidence that he used the means available to claim administratively, "said Toffoli in the decision.
The appointment of Mourão's son sparked discontent within the government, even surprising President Jair Bolsonaro. The PSol has filed a complaint with the Ethics Committee of the Presidency against the act. Mourão went to the defense of the son in social networks, claiming to have entered the bank 19 years ago and has "irreproachable behavior". When asked by GLOBO, the MP said:
