President Jair Bolsonaro on Friday signed an interim measure (MP) during a ceremony held at Plbadto Palace that provides measures to combat fraud in the benefits paid by Social Security.

Under the Temer government, disability benefits have already been controlled: sickness benefits and invalidity pensions. In two years, the comb has cleared 80% of revised sickness benefits and 30% of disability pensions.

Acting as an interim measure, the act of Bolsonaro will have the force of law as soon as it is published in the "Diário Oficial da União". As of this publication, the National Congress will have 120 days to badyze the MP and make it a final law. Otherwise, it will lose its validity.

See below the operation of each of these benefits and what has changed after the deputy:

What ? benefit of social security.

The family of the insured only receives the benefit if the prisoner's last earnings are equal to or less than R $ 1,319.18, discounted value annually. To be eligible, you must prove that you depend on the insured inmate. And the value of the benefit is divided equally among all dependents.

The duration of the benefit is 4 months from the date of imprisonment if the imprisonment takes place without the insured having paid 18 monthly social security contributions; or if the marriage or stable union begins less than two years before the arrest of the insured.

If imprisonment occurred after 18 monthly contributions and at least 2 years after the beginning of marriage or stable union, the maximum duration of benefit will vary: from 3 years for persons to Under-21 charge to life for dependents age 44.

For children, the benefit is paid until the age of 21, unless it is invalid or invalid or if it is emancipated. The parents of prisoners may, provided they prove their economic dependence, and their siblings, but must be under 21 years of age.

Dependents must submit to the INSS the statement of imprisonment / detention, provided by the prison units every 3 months. In the event that the insured has run away from prison or is serving an open sentence, the benefit ends.

The INSS is based on all social security contributions paid by the insured and deducts the lower amount of 20%. The average is the value of the benefit. As a result, the value received by dependents of the insured inmate may be greater than R $ 1,319.18.

What changes : "Restrictions" in the granting of imprisonment to prisoners in a closed regime, with a grace period of 24 months. Prisoners on a semi-open plan will no longer be entitled to the benefit. The MP prohibits the accumulation of help with confinement with other benefits. The evidence of low income will take into account the average of the last 12 wages of the insured and not only the last month preceding the arrest.

What : Compensation paid to dependents in the event of the death of the retired insured or the worker who worked in the urban perimeter.

Spouses, partners, children and stepchildren under the age of 21 or with a disability are entitled, provided that they have not emancipated; the parents; unemancipated brothers, under 21 or disabled.

If the insured has contributed less than 18 months or if the marriage or stable union occurred less than 2 years before the death, the dependents receive the benefit for 4 months .

If the death occurs after 18 monthly contributions from the insured and at least two years after the beginning of the marriage or stable union or in the event of an accident of any nature whatsoever, regardless of the amount of contributions and the timing of the marriage or stable union, the duration of benefits varies from 3 years for dependents under 21 to life for dependents aged 44 and more.

Spouses must prove the marriage or stable union on the date of death of the insured.

For children or siblings, the benefit is paid until the age of 21, unless it is invalid or invalid or if it is emancipated. Parents in situations of economic dependence are also entitled to benefit.

The calculation of the value is done by adding the premium wages higher by 80% after July 1994 (beginning of the Real plan). In the event that the deceased insured member of the INSS after 1999, 80% of the wages of the contributions are added upon their first payment.

On this sum of premium wages higher than 80%, it is divided by the number of months and the value of the benefit is reached. If the retiree leaves a pension, it will be the value of his retirement that his dependents receive.

What Changed : Justice today recognizes stable union relations or economic dependence on the basis of testimonial evidence and grants the benefit. The interim measure requires documentary evidence. From the day of the insured's death, children under the age of 16 will have to claim the benefit within 180 days of the death. According to the current rule, this term does not exist for retroactive purposes.

Operation : Allowance granted to a worker with at least 15 years of rural activity, above the minimum age of 60 for men and 55 for women, or 5 years , except as a rule. .

To be entitled to the special insured benefit, that is, without it being necessary to contribute to the INSS, the family farmer and the the artisbad fisherman must have 15 years of rural work certified by documents such as: declaration of the unions, lease agreements, partnership, mediation or rural credit, proof of the registration of the National Institute of Colonization and agrarian reform (Incra), proof of payment of the social security contribution, copy of the tax return and proof of payment of the tax on Rural Territorial Property.

In addition, the insured can not have another source of income. If the worker does not prove the minimum working time required as a special insured, he may claim the benefit of the benefit at the same age as the urban worker (65 for men and 60 for women), by adding working time as a special (rural) insured at the time of employment. urban work.

The value of the benefit for the special insured is a minimum wage. If you want a higher value, you must have a minimum contribution period of 35 years for men and 30 years for women. For the rural insurer who is not a special insured, the average of the 80% higher contributions from the insured is calculated since July 1994 (beginning of the Actual Plan). The INSS takes into account 70% of the average salary, with an increase of 1% per year in the insured's contribution, without being able to exceed the limit of 100% of the salary of the allowance. For example, if the insured has a 15-year contribution and is retiring at age 65, the amount of the benefit is 85% of the salary of the benefit (70% + 15 years of contribution = 85% of the salary). of the service).

What's Changing : A register of special insureds will be created to feed the National Register of Social Information (CNIS). From 2020, the CNIS will be the only way to prove the contribution time of the rural worker. Documents validated by the unions will no longer be accepted. Before 2020, the rural worker will confirm the contribution period by means of a self-declaration. In the next 60 days, it will be enough to make the self-declaration. Starting in March, the self-declaration will have to be approved by the entities of the National Program of Technical Assistance and Rural Extension (Pronater).

In addition to the amendments to the benefits, the Member also states:

  • Preventive Suspension of Fraud : The Member authorizes the preventive suspension of the payment of benefits in case of suspicion of irregularities with pre-trial evidence -constituted, until the recipient lodges a defense.
  • Payments after death : The Member states that the banks will be required to return the amounts deposited after the death of the beneficiary
  • Discount for undue payment ]: In case of payment greater than the benefit due to the insured, the Member authorizes the discount of the amount received unduly in the following installments or the recording of the debt on the active debt.
  • Expert career : doctor's expert leave the field of application of the INSS and are related to the Secretariat for Social Security of the Ministry of Economy. This measure adds to the list of tasks that can be performed by professionals, such as the review of pensions because of the disability of civil servants.
