Queiroz's defense claims not to know a turnover of R $ 7 million

Since last July, Queiroz, a friend of President Jair Bolsonaro since the 1980s, has been the subject of a criminal investigation initiated by the General Prosecutor's Office of Rio because of movements incompatible with his income. Asked to give explanations four times – December 14, 16, 19 and 21 – he did not attend the member, claiming a disability due to cancer.

The defense of the former adviser states that although he asked the deputy to access the information recorded by the Coaf on Queiroz, he did not obtain such documents.

– Last week I had requested access to this information and it was said that this had not been documented during the investigation. I asked for a copy of the information from the Coaf as well as all the witnesses who were heard. They did not deliver. They said: "Doctor, you have no information about Coaf after that." For me, it was a surprise to the press to have had this information without the defense having had access before.

The lawyer plans to return to the MP on Monday to ask again for Coaf's information referring to Queiroz's story. According to Klein, the fact that Queiroz is recovering from a surgical removal of a tumor, performed on January 1, prevented the client and his lawyer from meeting and, therefore, the defense to obtain Queiroz bank statements.

– I did not feel comfortable with him in this difficult time. I was with him on the 19th and then when he gave this interview to SBT, "Klein told GLOBO.

– I need to access excerpts. I already told him that we would need bank statements. I do not know if he has more than one account, I do not know if it's one account, I have not had access to extracts or to the movement of Coaf.

According to the lawyer, Queiroz is in São Paulo, where he is recovering from surgery performed at the Israelita Albert Einstein Hospital. The former adviser was removed from office on January 8.

– This was a large tumor that was already obstructing the pbadage of the intestine. It could have a generalized infection. Now he is doing post-surgical follow-up. He has a bag of colostomy and is preparing to undergo chemotherapy. This should begin this month.

Flávio investigated

For the counsel of the Queiroz lawyer, the elected Senator Flávio Bolsonaro is the subject of an investigation by the Rio Prosecutor's Office "from the beginning" – although the body denies it itself.

According to Klein, the mere fact that the investigation was conducted by the Criminal Offenders Group of the Office of the Attorney General (Gaocrim) and not by a trial prosecutor would explain this thesis.

– It does not seem reasonable to me to say that Flávio is not the subject of an investigation. This is not true If Flávio was not investigated, the case would not be in Gaocrim. This case would be with a trial attorney. Queiroz does not have a prerogative. If there had not been Mr Flávio since the beginning of the investigation, the case would not have been treated from the beginning in Gaocrim. From a procedural technical point of view, Gaocrim would have no reason to make an initial investigation on Queiroz if there was nothing from the beginning involving Deputy Flávio.

Last Thursday, the STF minister, Luiz Fux, granted an injunction to suspend the investigations of the deputy of Rio on Fabrício Queiroz. The suspension came at the request of Flávio Bolsonaro, who alleged that the member would not have jurisdiction to investigate the newly elected and graduated senator. Flávio's defense also requested the cancellation of evidence obtained so far, stating that
banking and tax secrecy had been violated without the authorization of a judge

The reporter of the STF case, the Minister Marco Aurelio Mello, said that he should release the investigation after the suspension of the court hearing in February. Measures such as requests for breach of bank secrecy can therefore only be taken starting next month.

– This inquiry being paralyzed, not at my request, does not benefit Queiroz at all, because Queiroz will have to give some clarifications at some point. The investigation on him will continue regardless of Flavio's discussion – said Paulo Klein, commenting on Minister Fux's decision.

Asked by GLOBO, Flavio Bolsonaro's counsel said the elected senator would not comment on the case. Rio's attorney general, Eduardo Gussem, also declined to comment.
