Justice suspended the increase of the bus fare in São José dos Campos (SP). The decision, rendered by Judge Laís Hellena Scamilla Jardim, responds to a preliminary injunction of the Ombudsman. The order was released late Thursday afternoon (24) – four days before the increase to R $ 4.90.

The action of defender Jairo Salvador argues that the municipality did not comply with the organic law that obliges the city council to promote user participation in the study, in the audit and the definition of public transport rates in the municipality. This would require public hearings.

In the context of the civil action, the defender examined a sentence pronounced last November against a previous legal action initiated in 2015 which had at the time called into question the readjustment of the pbadage. In this document, the court held that the tariff should be discussed with the company. Merit has not been tried yet.

"This 2015 issue, which is still ongoing, has not been resolved yet and the city government now wants to apply a new adjustment," said Salvador.

The G1 searched for City Hall, which did not comment on the decision. The government has just declared that it creates the city council for urban mobility.

Currently, the ticket costs R $ 4.10 for ordinary users and R $ 4.70 for companies that buy transport vouchers. With the expected increase, it would reach R $ 4.30 and R $ 4.90, respectively.

The increase is 4.87% for the user of a single ticket and 4.25% for the ticket. In alternative transport, the new fare will be unique, at R $ 4.30 – this because the modality does not count with electronic ticketing.

Public transport is operated by Saens Peña, Expresso Maringá and CS Brasil. Together, according to the town hall, they serve more than 100 lines and have nearly 400 buses in circulation. Last year, there were 84.5 million trips.
