The Crimean Specialized Police Department (Decon), in partnership with Procon Municipal, launched the operation "Fictus III" on Friday morning to combat the sale of counterfeit goods. The action took place in a commercial house located in the center of Cuiabá, where about 400 pirated products of the brands Adidas, Nike, Calvin Klein and Billabong were seized.
The transaction was triggered after Decon received information that the establishment called "Josely Confecçes" in the north-central district would market several well-known brands of clothing of a lower value than market, in the case of pirated products. ]
On the spot, Decon police and prosecutors concluded that the complaint was true. 397 replicas were entered: 197 Adidas shorts, 25 Nike shorts, 85 Adidas short-sleeved t-shirts, 04 Adidas, long-sleeved t-shirts. 01 Nike t-shirts, 14 Nike long-sleeved t-shirts, 03 Calvin Klein short-sleeved t-shirts with short sleeves, 08 Billabong short-sleeved t-shirts, 60 adidas.
The store owner, C.-BC, stated that the products were purchased in São Paulo (SP) and Goiania (GO) and that they had no invoice because they were second line products.
The owner was interrogated at the headquarters of the consumer police and released. The specialist will wait for the confirmation of the official expertise and technical identification (Politec), which will conduct an expertise of the goods to prove counterfeit or falsified products.
According to delegate Antonio Carlos Araújo, replicas of famous brands have been sold at a price much lower than that of the market. "The establishment is aimed at the low-income public and the coins have been sold between $ 15 and $ 20, regardless of brand," said the delegate.
Behavior related to the trading of counterfeit or pirated goods is described in Article 190, paragraph 1 of Law 9.279 / 96 of the Industrial Property Code, punishing 3 months at 1 year; Article 7, point 7, VII of Law 8.137 / 90 of the Consumer Relations Act, 2 to 5 years fine or fine; for commercial fraud, provided for in Article 175, point I of the CPB, as well as for infringements of the Consumer Protection Code (Law No. 8.078 / 90 in Article 67).
The original products are manufactured in accordance with the legislation and control of the Brazilian health surveillance agencies, in order to ensure their safety and effectiveness. False products do not pbad this control and do not have the same guarantees as the originals, in addition to not respecting the technical specifications of manufacture, hygiene and safety.
