Published in 2017 by the then president, Michel Temer, the MP responded to a request from the truckers. In April of last year, the category went on strike for 11 days to protest the rising price of diesel.

In June of last year, Fux suspended all business in the country involving the freight table until the Supreme Court considered the merits of the case. The Confederation of Agriculture and Livestock, for example, filed a lawsuit before the court, claiming that the measure undermined free competition.

After the suspension of the measure, the Attorney General of the Union asked the Supreme Court for clarification, claiming that lower court judges had begun issuing injunctions in favor of companies and entities to suspend the freight rate.

One of the decisions was favorable to the Federation of Industries of the State of São Paulo (Fiesp), which had obtained an injunction to companies related to the entity.

In Thursday's decision, Fux states that the reasons for the previous decision "remain healthy". According to the Minister, it is necessary "to maintain legal certainty until this court resolves the controversy over the maintenance of the above-mentioned law".
