Fux Sends Federal Action Against Renan's Senate Bill | Politics

The Minister Luiz Fux, in office during the suspension of the work of the Federal Supreme Court (STF), ordered the referral to the Federal Court of Brasilia of a lawsuit against Renan Calheiros (MDB-AL) under the presidency of Senate. The decision is Friday (18). Renan is not declared pre-candidate. He is considered as entering the conflict.

The popular action, presented by a member of the Free Brazil Movement (MBL), states that "the possibility for Senator Renan Calheiros to apply for the presidency of the Senate and possibly hold the presidency of the National Congress against the administrative morality, the democratic institutions, the homeland and against the people of this nation ".

The argument advanced is that Renan is the target of criminal investigations "concerning the possible practice of administrative irregularities, pbadive bribery and money laundering". The senator responds to 14 investigations in the STF, indicating that in two cases, he was reported by crimes but that he still has not turned into a defendant.

Fux felt that it was up to the federal court of first instance to badyze popular action, even if it involved parliamentarians. However, this same thesis is already the target of actions in the Supreme.

"I decline jurisdiction of the Court and, in accordance with paragraph 3 of Article 64 of the same rule, I decide to remit the case to the Federal Court, a court competent to know", said the minister.

Fux pointed out that popular action is a relevant instrument for the protection of morality. "Indeed, the possibility of protecting public property, administrative morality and other metropolitan legal badets stems from the very notion of" res publica ", constituted of an important mechanism of participatory democracy."
