Gilmar Mendes orders the release of Wilson Carlos, former secretary of Cabral | New Orleans hotels

In authorizing the release, Gilmar Mendes imposed three provisional measures:

The defense of Wilson Carlos argued with Minister Gilmar Mendes that he was a principal defendant and that he had good history.

Minister Says Insufficient Reason

According to Gilmar Mendes' decision, former secretary Wilson Carlos was sentenced at first instance to 34 years in prison and fined for the crime of pbadive bribery, money laundering and criminal organization.

For the Minister, the judge did not explain well the reasons for keeping the prison.

"I understand that the reasons given by the original magistrate, by maintaining the applicant's detention on remand, Carlos Carlos Cordeiro da Silva Carvalho (Criminal Action 0509503-57.2016.4.02.5101), also prove to be at this stage of the procedure, the preventive segregation considered, insofar as this preventive detention did not meet the requirements of Article 312 of the CPP, in particular as regards the indication of Concrete elements which, at the time of promulgation, were immediately incidental to the point of taking a precautionary decree.
