Small and micro debtors active in the Union can apply for debt refinancing from the Internal Revenue Service until Monday (9) , by the Special Program for the Fiscal Regulation of Microenterprises and Small Door Enterprises. According to the Support Service for Brazilian Micro and Small Enterprises (Sebrae), more than 320,000 entrepreneurs participated in the project.

Debtors of the Single National Plan and the Individual Microentrepreneur who have debts maturing in November of last year are eligible for refinancing.

The Federal Income Survey indicates that up to April of this year across the country, more than 3.7 million small businesses were in default, for a total of more than 32.4 billion reais. Those who keep the outstanding debt and do not regularize the situation with the income can be prevented from issuing a negative debt certificate (CND) and excluded from the National Single. Companies that were already excluded from SIMPLE in January for not having incurred debts can also benefit from Refits.

How It Works

Membership in refinancing is done exclusively on the Internet, at Simples Nacional or the IRS Virtual Service Center page. By joining the program, other types of down payments opened by the contractors are automatically canceled.

Beneficiaries of the program must initially pay 5% of the debt, without discount. The entry can be divided up to five times. The remaining 95% of the debt can be paid in one go or in two different installments, up to 145 or 175 months.

If the debtor pays the debit balance in one installment, default interest is reduced by 90%. %, fines at 70% and legal fees, including attorney fees, at 100%. If the choice is for payments up to 145 times, the reduction is 80% interest on arrears, 50% fines for late payments, office or isolated. For contracts with installments up to 175 times, the reduction of default interest will be 50%, fines of 25% and 100% of court costs.

Individual Microentrepreneur (MEI) companies will pay a minimum deposit of R $ 50.00. For other micro and small companies opting for Simples Nacional, the minimum deposit is R $ 300.00.

The microfinance debt refinancing program was regulated in April of this year after the National Congress canceled the presidential veto to the bill approved by parliamentarians at the end of the year. from last year (link). The government economic team withstood the possibility of splitting the debts with a discount. However, industry entities claim that tax simplification measures have support in the Constitution, which provides for differential treatment for small businesses.
