The text provides for the continuation of the privileged forum only for the heads of the three powers (President and Vice-President of the Republic, and Presidents of the House, the Senate and the Federal Supreme Court).

The privileged forum – or special forum by prerogative of function – is provided for in the Constitution. This is the device that guarantees the authorities, such as the President of the Republic, Senators, MPs and Ministers, the right to be investigated and d & # 39; to be judged solely by the Federal Supreme Court (STF). In the case of governors, the forum is the Superior Court of Justice (STJ). Mayors are tried by courts.

If the CEP is promulgated, the authorities with a privileged jurisdiction will now be prosecuted and tried in the first instance of justice, as any citizen, if they commit crimes under ordinary law.

The proposal approved by the special committee of the House fully retained the version of the constitutional amendment proposal approved by the Senate in May of last year.

The House considered the text on Tuesday during a brief meeting that took place during the voting hours of the House's main plenary.

If the text was not pbaded before the end of the legislative year, December 22, it would be necessary to close the special commission and create a new group of experts to review the PSC, this which would delay the procedure. With the approval in committee, the text now moves to the House plenary.

However, deputy ministers should not badyze the CEP of the privileged forum until next year, because the federal intervention in the public security of Rio de Janeiro and Roraima prevents taking into account, in session Plenary, texts amending the Constitution.
