RIO – The judge
Siro Darlan
, chairman of the 7th criminal chamber of the Rio Court of Justice, is suspected of having released prisoners during guard duty in exchange for tips. Darlan is currently under investigation by the High Court of Justice (
STJ
), which determines the sale of phrases in the capital forum.

In two investigated cases, the detainees reportedly benefited from Darlan's decisions. One of them was linked to the award-winning collaboration of one of the parties, who claimed to have heard one of the prisoners talk about the payment to a magistrate's intermediary: $ 50,000 to be released. Initially, according to the report, the offer had risen to R $ 120,000, but had fallen to less than half, divided into two installments.

Darlan is a controversial judge in the Rio Court of Justice (TJ-RJ) for his recurrent decisions to release prisoners in court. In addition to the STJ's investigations, it is also subject to a presidential representation of the TJ-RJ, signed by the other four judges of the 7th Chamber, and an investigation by the National Council of Justice (CNJ) to investigate disciplinary offenses.

One of the STJ's investigations originates from Resende (RJ). The economist Ricardo Abbud, president of the Retail Trade Union of the municipality, was arrested in 2015 and 21 others were accused of committing irregularities at the city council. The informant told the Special Action Group for Combating Organized Crime (Gaeco) that when Abbud was imprisoned with him, he told him that his father, João Bosco de Azevedo, had negotiated "with someone interposed by Judge Siro Darlan "the amount of $ 50,000 for his freedom.

The economist was released by the Judiciary, by which Darlan was appointed, on October 30, 2015. On the second day of freedom, he went to the retail trade union of Resende, where he was president. There are indications that he left to destroy evidence.

The other case being investigated is that of prisoner Samyr Jorge João David, who is responsible for attempted theft, theft and interception. His arrest was pronounced in June 2016. His attorney, Hugo Sant 'Anna Onofre Alves, has filed two habeas corpus appeals in favor of Samyr: one for the attempted theft crime and the l'. other for the flight. Both claims were allegedly directed specifically at the judicial injunction of the investigation, which determined the release of the prisoner.

The injunction granted by Darlan on October 1, however, was revoked by Judge Flávio Marcelo de Azevedo Horta Fernandes, who reinstated Samyr's pre-trial detention on October 4, 2016. Fernandes pointed out in his ruling that defendant directed habeas corpus petitions at Darlan Despite Samyr's new arrest decision, the judge of Nilópolis' first criminal court, Alberto Fraga, informed that the defendant was already at liberty because of the Darlan's injunction.

During an authorized telephone interception, Samyr's lawyer – who had already responded in 2001 to a motorcycle robbery – was caught in a conversation with a former Darlan driver, Luís Eduardo Soares. Soares is known in the Criminal Chamber Building as Mister Bean for resembling the character of the English comedian Rowan Atkinson.

In 2005, Soares, then Darlan's advisor, was arrested for taking away 80 courtesy tickets at the ticket counter of a concert hall on behalf of the judge in charge of the first court for children and youth and elderly people in the capital. Darlan asked to be exonerated after the incident, but continued to maintain relations with the former counselor.

In 2017, Darlan volunteered for shifts. Each night worked corresponded to two days of vacation, but in the Superior Court of Justice, the idea that lawyers directed the petitions for him was consolidated. With a series of scandals so far unpunished, the NYC forced the TJ-RJ to end the voluntary duty and establish an annual scale of 180 judges.

After receiving news of the STJ investigation on which she appears to have been the subject of an investigation, Judge Siro Darlan said he was surprised at the fact that he had been arrested. ;investigation. He stated that he was aware of the disciplinary complaint filed with the NYC, specifically with regard to the suspicion that Abbud had paid his alleged "middleman".

– In the CNJ case, I judicially intercepted Abbud and his father, Bosco, for criminal purposes. They denied any kind of irregularity against me. I also sued the plaintiff for moral damages, but the judge understood that it was not worth punishing someone who was collaborating with the judge. In the case of Abbud, I asked for precautionary measures, because it was not his prison, because they were crimes like auction fraud.

Regarding the freedom granted to Samyr, Darlan said that he did not remember the case.

– Were they on my side anyway? I do not remember it. Anyway, I find it great that you are investigating me. I am the first interested in that. There are people who do not like to act as guarantor, to follow the Federal Constitution.
