Among the justifications presented by the judge for the conversion of the temporary prison of Laurence Lourenço and Pedro da Silva in preventive terms is the fact that the respondents did not move away from the functions and public functions, "being Laurence, until 39 on the day of completion of the measures, President of Companhia Energética de São Paulo. " It also places the risk of destruction of evidence, constraint of witnesses, hindering investigations, disposal of property arising from illicit activity and other crimes.
For other investigations, the decision determines, among other measures, a monthly ban, a ban on contact with any employee or former state employee, the prohibition to leave the country, the suspension of public functions and economic activities related to the work of North Rodoanel or any other involving public resources.
Operation
The investigation that led to the operation Pedra no Caminho began in 2016 with the initiation of an investigation following the complaint from a former director of a contractor. According to the Federal Prosecution, frauds involving discrepancies and overbilling are linked to an agreement signed between the State and the Union for 6.4 billion reais. The prosecution estimates that the spreads reached R $ 600 million.
In a note, Dersa said that the company and the government of São Paulo are most interested in the progress of the process. "If there is possible damage to the public treasury, the state will take the necessary measures, as it has done on other occasions," the company said.
Additives
Contractors acted by adding admixtures to contracts for, for example, removing rock formations that would have been discovered during the earthworks. However, according to the federal police, these rocks were already planned, including in the geological studies of the 1960s.
In addition to previous studies, the Institute for Technological Research (IPT) conducted a new study demonstrating that the rocks the additives were part of the original work plan, the additives were therefore uneven.
