The Public Prosecutor's Office of the State of Rio de Janeiro (MPRJ) has lodged a complaint against Antonio de Almeida Anaquim for manslaughter and bodily injury to the car which, in January, invaded the Copacabana Beach promenade, a baby and a man, and wounding another 16 people.
In the complaint, the MPRJ says that Antonio Antonio acted negligently because although he was fully aware that he had neurological impairments due to n a clinical condition of epilepsy, he denied these conditions when renewing his national driving license. The Crown adds that the driver was receiving medical treatment as early as adolescence to avoid recurring "breakdowns" and was aware of this. At the time of the coup, Anaquim had the right to drive suspended, and even then, he drove the car, thus aggravating his liability in the accident, he points out the complaint.
For the conduct of the driver, the MPRJ requires his conviction in accordance with Articles 302 (1), sections I and II (twice) and 303 (1) (16 times) of Law 9503/1997, under the form of Article 70 of the Penal Code, which provides for the arrest, suspension and prohibition of the right to control.
