The PCdoB entered the Federal Supreme Court (STF) on Thursday (17) with an action challenging the decree of President of the Republic, Jair Bolsonaro, which facilitates the detention of firearms. The legend of the opposition asked the court for an injunction (interim decision) to suspend several provisions of the decree until the merits of the complaint were decided by the Supreme Court in plenary.

The rapporteur for the STF action will be the Minister Celso de Mello, who will return from the suspension of the judiciary only on 1 February.

According to the opposition party, there was "abuse of regulatory power" on the part of the executive, because it would be up to parliament to legislate on the matter.

"This circumstance entails the formal unconstitutionality of the devices," says the act of action.

The decree signed last Tuesday (15) by Bolsonaro eases the rules for obtaining the right to own firearms.

Possession is permission to keep a firearm at home or at work (provided the owner of the firearm is the legal guardian of the establishment).

The text of the decree authorizes citizens living in urban or rural areas to keep their firearms at home, provided they meet the requirements of "actual necessity", for examination by the federal police.
