The Justice of Rio de Janeiro sentenced the former state governor, Rosinha Garotinho, for administrative irregularity because of a health fraud at the time when he exercised command. The decision, first instance, made public Tuesday (8) was signed December 19.

The sentence provides for the suspension of Rosinha's political rights for a period of 8 years, in addition to the loss of public office. He will also have to pay an indemnity of 234 million rand to the public coffers of the State; R $ 2 million compensation for collective damages; and R $ 500,000 of civil fine.

The defense of the former governor said that she would appeal the decision.

Rosinha and her husband, former governor Anthony Garotinho, were indicted by the prosecutor's office of Rio (MP-RJ) for participating in a program that had embezzled 234 million rand from the Department of Health from the state of 2005 and April 2007. At the time, the state of Rio was ruled by Rosinha and Garotinho was the state secretary of the government.

In this same case of improbity, Garotinho had already been convicted, in a decision confirmed at second instance last July. He also became ineligible for 8 years.

The conviction stems from the illegal outsourcing of the Pró-Cefet Foundation, with waiver, to the management of the "Health in Motion" project, which cost public coffers 234 million rand. According to the court, the contract was possible only because Garotinho, as secretary, intervened to have the contract in place with the Public Service School Foundation (FES), which was administering the project, thus opening the way to the fraudulent agreement with Pro -Cefet.

"There is no doubt that the maintenance of the" quarantine "regime for the provision of services related to the final activity has been proven, without derogation, and the unjustified intermediation of NGOs and small NGOs without technical qualification and no effective service is provided, except for the constitution of a management committee, which will later feed the husband of pre-candidacy, Anthony Garotinho, "Judge Daniel Schiavoni Miller, President of the 4th Treasury Court.

She stated that there was no evidence that these NGOs were providing services that would justify the high payment that they had received.

"In a certain way, the answer is given, even if it has been delayed, it has arrived, which implies the future of politicians who have committed irregularities in the past. public "commented the promoter Gláucia Santana, MPRJ, about the sentence.
