In his decision, the STF's minister, Alexandre de Moraes, felt that there was no illegality in the governor's prison of Rio de Janeiro.
"In this perspective, the agreement established in the impugned decision is not flagrant illegality, because according to the Supreme Court, the current mode of execution and the concrete gravity of the crime justify the determination of preventive detention law and order, "he added.
The Minister dismissed the injunction, but there will always be a merit judgment.
"Thus, in this interlocutory judgment, there is no obvious unlawful compulsion to the patient's right to liberty to warrant the grant of a preliminary injunction to revoke ordered preventive detention. The controversy will be badyzed at the time of its final judgment, "concluded Alexandre de Moraes.
The Minister also considers that the need to ensure public order is "imperative", which is mainly demonstrated by concrete facts to which one attributes extreme gravity and which impose a delineated reproach and undeniable harm to the treasure .
