For people aged 41 to 43, the time to receive the benefit is 20 years. For partners between 30 and 40 years, it is 15 years of payment. Between 27 and 29 years old, it is 10 years old. . The amount of the death pension corresponds to 100% of the pension received by the insured or to which he would have been entitled if he had retired for disability. If there is more than one dependent, the benefit is divided between them.
In the case of spouses who lived in a stable union, but without a certificate issued by a notary, the INSS currently requires the submission of at least three supporting documents.
According to Luiz Felipe Veríssimo, director of the Instituto de Estudos Previdenciários (Ieprev), it is common to have a religious marriage certificate, a joint birth certificate, a common bank account, a proof of common residence, etc.
– In many cases, the INSS refused the concession, claiming that the documents were not sufficient. But the court process usually only requires one document, provided the person corroborates with testimonial evidence.
Among the changes that should be included in the interim measure, there is contemporary documentary evidence which, according to Veríssimo, is evidence of the duration of the beginning at the time of death.
– Depending on the changes that will be made, it may be more difficult for people to access the pension by administrative means, but on the judicial side, it does not change much.

In addition to the death pension, changes are also expected in reintegration and retirement in rural areas. In the first case, the benefit will benefit from a minimum grace period of 12 months and a low income measure based on the average salary received by the insured.
